These terms are the agreement between you and Daytify OÜ about your use of daytify.com. Please read them. By registering an account you accept them.
Daytify is free to register. Sending messages is not free. A message costs dayts, and dayts are bought with money. Section 7 explains this, and the full price list is on the Purchase & Dayts page.

We run an online dating website. In these terms, “we”, “us” and “Daytify” mean Daytify OÜ, and “you” means the person using the site. All prices on Daytify are shown in euros (EUR).
2. These terms and our other documents
These terms apply together with:
Where one of those documents deals with its own subject in more detail, that document applies to that subject. Nothing in any of them takes away a right that Estonian or European Union consumer law gives you.
3. Who may use Daytify
You must be 18 or over. Daytify is for adults only.
How the age check actually works
We would rather be plain about this than sound impressive:
- When you register, you enter your date of birth and tick a box confirming you are 18 or over.
- Our server checks that date of birth on its own, independently of the tick box. If the date shows you are under 18, registration is refused. Ticking the box does not get you past that check.
- We do not check identity documents, and we do not compare your date of birth against any official record. There is no automated document check on this site.
So the check works only if what you tell us is true. Giving a false date of birth is a serious breach of these terms. If we learn that an account belongs to someone under 18, we close it.
If you believe a member is under 18, tell us at safety@daytify.com straight away. We treat those reports as urgent.
You also need the legal capacity to enter into a contract, and you must not use Daytify on behalf of a person whose account we have closed.
4. Your account and its security
- Registering is free of charge and open to anyone who meets the requirements in section 3.
- Give real information about yourself and keep it current.
- Your account is personal to you. Do not share it, sell it, or let anyone else use it.
- Use a password you do not use anywhere else, and keep it to yourself.
- If you think someone else has got into your account, write to support@daytify.com.
When you register, we record proof of what you agreed to: the version of the text you accepted, the time in UTC, your IP address, and your browser’s user agent. That record protects both of us.
5. What Daytify does, and what we do not promise
Daytify lets you create a profile, search and browse other members, and get in touch with them. You can add photos, audio and video, keep some photos private, save searches, mark favourites, send friend requests, use Meet Me, see who viewed your profile, comment on profiles, and send flirts and virtual gifts.
What we do not promise:
- We do not promise you a match, a date, a relationship, or any other outcome.
- We do not promise that anyone will reply to you, or that any particular number of members will be active near you.
- We do not promise uninterrupted access. We take the site down for maintenance sometimes, and things occasionally break.
Please use ordinary caution with people you meet online. Meet in a public place, tell a friend where you are going, and do not send money to someone you met here.
6. How you must behave
These rules are short, and they are not negotiable. On Daytify you must not:
- Harass anyone. No threats, no stalking, no hate speech, no abuse aimed at who a person is. If someone asks you to stop contacting them, stop.
- Involve minors. Never post, send or request sexual content involving anyone under 18, and never attempt to contact a minor for that purpose. There is no context in which this is acceptable, and we report it to the authorities.
- Impersonate anyone. Do not use a false identity, and do not misrepresent who you are. Do not use photographs of another person as though they were you. Do not create or run an account on someone else’s behalf. Do not pretend to speak for Daytify or for any other organisation.
- Sell or advertise. No commercial solicitation of any kind: no advertising, no recruiting, no offering sexual services for payment, no promoting other sites, no multi-level marketing, no spam or chain messages.
- Ask members for money. No romance scams, no investment tips, no emergency stories, no gift-card requests.
- Expose other people. Do not post someone else’s private information, and never share intimate images of a person who has not agreed to it.
- Post unlawful content, or content that infringes another person’s copyright, trade mark or other rights.
- Scrape the site or automate access. No bots, crawlers or scripts, no bulk collection of profiles, photos or contact details, and no automated account creation.
- Attack the service. No attempts to break in, no security testing without our written permission, no reverse engineering, and nothing that interferes with other members’ use of the site.
- Avoid the charges. Do not try to perform paid actions without paying for them, and do not tamper with your dayt balance.
You are responsible for what you post and for how you treat other members.
Reporting and blocking
Profiles and comments carry a report button, and you can block any member so they cannot contact you. You can also write to safety@daytify.com.
Photos, audio and video appear on the site as soon as you upload them. We do not review them beforehand. We review content once it is reported. What we can do about content and accounts, how we decide, and how you can challenge a decision are set out in Content Moderation.
7. Dayts and paid actions
Registering is free of charge. Sending messages is not. Messages and certain other actions cost dayts, and you buy dayts with money.
The base rate is 100 dayts = €1, so one dayt is €0.01. Larger packages include bonus dayts. Package sizes and prices are listed on the Purchase & Dayts page.
What actions cost:
- Sending a message: 5 dayts (€0.05)
- Sending a flirt or wink: 2 dayts (€0.02)
- Sending a virtual gift: 10 to 350 dayts, depending on the gift
- Profile Boost: 50 dayts for 30 minutes, 120 dayts for 3 hours, 400 dayts for 24 hours
Before you send a message, the send form shows what it costs and what your balance is. If your balance is too low, the action is refused and nothing is charged.
Profile Boost is paid placement. For the time you have paid for, your profile is shown at the top of the members list. It does not override a list where a member has chosen their own sort order, such as alphabetical or oldest first, and it does not promise you views, replies or matches.
We do not currently sell subscriptions. Dayts are the only thing you can buy on Daytify.
What dayts are, and what they are not
Dayts are prepayment for our own service. They are not money and not a payment instrument. To be specific:
- Dayts are not transferable. You cannot give, sell, trade or send dayts to another member or to anyone else.
- Dayts are not redeemable for cash. Your balance is not a way to store, move or withdraw money.
- Dayts can be used only on Daytify, for the actions listed above.
- No third party accepts dayts. They have no use or value anywhere except on this site.
None of that affects your statutory rights. Where the law gives you money back, for instance when you withdraw from a purchase or when your account closes while you still hold unspent dayts, you get money back under the Refund Policy. That is the repayment of a price you paid us, not an exchange of dayts for cash.
Unspent dayts are never forfeited
This one matters, so it gets its own heading. Your unspent dayts are not cancelled and do not expire. They are not lost if you stop using the site, not lost if you close your account, and not lost if we suspend or close it, including where we close it because you broke these terms.
If your account closes while you still hold unspent dayts, we repay the part of the price that corresponds to them. Write to support@daytify.com, and see the Refund Policy for how it is handled.
Buying dayts
- Prices are shown in euros (EUR) and are the total amount payable for the package you choose.
- The payment methods available to you are shown at checkout.
- Before you pay, you confirm two things: that you have read these terms and the Refund Policy, and that you want your dayts credited immediately.
- The button that completes the purchase is labelled “Order with obligation to pay” and shows the amount and the payment method. Pressing it creates an obligation to pay.
- We produce an invoice automatically. It is emailed to you as a PDF and stays available in your purchase history.
As a consumer you have a 14-day right of withdrawal. Because dayts are credited to you immediately, that right works in a particular way: unspent dayts are refunded, and we charge proportionately for the part you have used. The Refund Policy sets this out in full and contains the withdrawal form.
8. Your content, and the licence we need
Your photos, videos, audio and words remain yours. We claim no ownership of anything you post.
To run the site we need your permission to handle that content. You therefore give us a licence to store it, to make the technical copies needed to operate and back up the service, and to display it to the members and visitors your privacy settings allow. The licence is non-exclusive, worldwide because the site can be reached from anywhere, and royalty-free, meaning neither of us pays the other for it.
The licence is limited to running Daytify. We do not sell your content, we do not license it to advertisers, and we do not use it in advertising off the site.
The licence lasts as long as the content is on Daytify. When you delete a photo, or delete your account, the licence over that content ends. Copies may persist briefly in backups while those backups rotate, and we keep what the law requires us to keep.
Post only content you have the right to post. If another person appears in your photo, make sure they are content to appear on a dating site.
You can ask us for a copy of the content you have put on Daytify. We provide it free of charge, in a commonly used machine-readable format.
9. Data protection
What we collect and why is set out in the Privacy Policy. Two points belong here as well.
Some of what you tell us is sensitive. Who you are looking for, combined with your own gender, can reveal your sexual orientation, and that is a special category of personal data. We process it only on your separate, explicit consent, which you give separately from accepting these terms and can withdraw separately at any time.
Withdrawing a consent is not a breach of these terms. We will not penalise you for it, charge you for it, or claim anything from you because of it. What it does mean is practical: if we may not process the details that make up your profile, we cannot display your profile. Should that leave us unable to provide the service at all, we will tell you and you can close your account. Your unspent dayts are handled as described in section 7.
10. Ending the agreement
You can leave at any time
Delete your account from your account settings whenever you like, without giving a reason and without paying a fee. If you would rather we did it for you, write to support@daytify.com.
When we can restrict, suspend or close an account
We can restrict, suspend or close an account where you have broken these terms, in particular the rules in section 6, or where the law requires us to. If content or conduct is unlawful or is causing serious harm, we can act immediately.
When we do, we tell you what we decided and why, and how to challenge it. Write to safety@daytify.com and a person will look at it again. Our view of whether you broke these terms is not the last word on the matter: you are free to dispute it, and the bodies and courts named in section 14 can decide it.
Whatever the reason for closure, your unspent dayts are not forfeited. See section 7.
We may also stop offering Daytify altogether. If we do, we give you at least 30 days’ notice by email, and we repay the part of the price that corresponds to your unspent dayts.
11. Changes to the service
Daytify will change over time. We may add, alter or withdraw features, and we may change what an action costs in dayts. We do so only where there is a valid reason, and we will say which reason applies. Valid reasons are:
- a change in the law, or a decision of a court or a supervisory authority;
- security, fraud prevention, or the protection of members;
- technical necessity, for example where something the site depends on changes or is discontinued;
- a genuine change in what it costs us to provide the service;
- improving the service, or replacing a feature with a better one.
A change to what an action costs applies only to actions you take after the change is in force. It is never applied to something you have already done.
If a change would adversely affect your access to the service, or your use of it, other than in a minor way, we will tell you on a durable medium, by email to the address on your account, at least 30 days before it takes effect. In that case you may terminate this agreement free of charge within 30 days of the notice or of the change taking effect, whichever is later, and we repay the part of the price that corresponds to your unspent dayts. A change never puts an extra cost on you.
12. Changes to these terms
We may change these terms, but not whenever we feel like it and not quietly. We may change them only where there is a valid reason, and the notice will state the reason. The valid reasons are the same as in section 11: a change in the law or in a decision of a court or authority; security or fraud prevention; an unavoidable technical change; a genuine change in our costs; or a change in the service itself that the terms have to describe. We may also correct errors and make the wording clearer, which does not alter what we owe you.
How a change is made:
- We notify you on a durable medium, by email to the address on your account, before the change takes effect.
- The notice says what is changing, why, and from when.
- Where the change adversely affects your access to the service, or your use of it, other than in a minor way, we give at least 30 days’ notice and you may terminate this agreement free of charge within 30 days. We repay the part of the price that corresponds to your unspent dayts.
- A change never imposes an additional cost on you.
If you do not wish to accept a change, closing your account is always open to you and costs nothing.
13. Responsibility
We are responsible for providing Daytify with reasonable care and skill, and we answer for our own failures. We do not attempt to sign away liability that Estonian law does not permit us to sign away.
In particular, we do not exclude or limit our liability:
- for death or personal injury caused by us;
- for damage caused intentionally or through gross negligence;
- in any other case where Estonian law does not allow it.
For other damage, we are liable for loss that follows from our breach and that could reasonably have been foreseen when this agreement was made.
Some things are genuinely not ours to answer for:
- What other members write, post, promise or do, whether on the site or after they meet you. Members are not our employees or our agents.
- Loss caused by your own breach of these terms, or by someone obtaining your password because you shared it or reused it elsewhere.
- Interruptions caused by circumstances beyond our reasonable control, such as a network outage, a supplier failure or a natural event.
Nothing in these terms shortens the period the law gives you to bring a claim, and nothing in them moves onto you the task of proving something the law says we must prove.
14. Complaints and disputes
Come to us first
Send complaints to support@daytify.com, or to safety@daytify.com where the complaint concerns another member’s conduct or content. Tell us what happened, what you would like us to do, and how to reach you.
What we then do, as Estonian consumer law requires:
- We confirm that we have received your complaint.
- We give you a substantive answer within 15 days of receiving it, stating whether we agree to what you have asked for.
- If we need longer, we tell you so in writing, explain why, and give you a new deadline.
- If we refuse your claim, we tell you in writing and give our reasons.
- If we do not answer by the deadline, you may treat that as a refusal and go straight to the bodies below.
If we cannot settle it between us
You can bring a consumer dispute to the Consumer Disputes Committee (Tarbijavaidluste komisjon), which operates at the Estonian Consumer Protection and Technical Regulatory Authority:

The committee’s rules of procedure, and the form for submitting a complaint to it, are published on www.ttja.ee. We take part in its proceedings.
If you live in another country in the European Union, or in Norway or Iceland, the European Consumer Centres Network (ECC-Net) can help you with a cross-border complaint free of charge. The European Consumer Centre in your own country will advise you and can approach us on your behalf.
Going to either of these bodies does not stop you from going to court.
15. Governing law and courts
This agreement is governed by Estonian law.
If you are a consumer resident in another country of the European Union, that choice does not deprive you of the protection given to you by the mandatory consumer-protection rules of the country where you live.
You may bring proceedings against us either in the courts of the country where you live or in the Estonian courts, whichever you prefer. We may bring proceedings against you only in the courts of the country where you live.
16. Other points
- These terms are written in English (en-GB). English is the language of this contract and of our correspondence with you.
- If a court finds one clause invalid, the rest of the terms remain in force, and the invalid clause is replaced by the rule the law provides.
- You cannot transfer your account, or your rights under this agreement, to anyone else.
- If we do not enforce a rule immediately, we do not lose the right to enforce it later.
